These Terms of Use (“Terms”) are a legally binding agreement between you and BobCAD-CAM, Inc. (“BobCAD,” “we,” “us,” or “our”) governing access to and use of this marketing website (the “Site”). By using the Site, you agree to these Terms and to our Privacy Policy and Cookie Notice. If you do not agree, do not use the Site.

1. Eligibility

The Site is intended for adults who are evaluating or using CAD/CAM software in a business or professional capacity. You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Site or submit the contact form. You represent that you have authority to use the Site on behalf of yourself or the organization you name.

2. The Site

The Site provides general marketing information about BobCAD-CAM products, a way to request a demo or contact a specialist, and links to purchase or learn more on other BobCAD properties. Content is for information only. Features, screenshots, pricing mentions, and product descriptions may change and may not reflect the configuration available to you.

We may modify, suspend, or discontinue any part of the Site at any time without notice. We do not guarantee that the Site will be uninterrupted, error-free, or available from every location.

3. Software, licenses, and purchases

These Terms do not license BobCAD-CAM software. Software is licensed only under the end-user license agreement (EULA) presented when you download, install, or purchase the product. Usage-statistics practices for the desktop software are described at bobcad.com/privacy/software-usage.

Links labeled Purchase (including /purchase) redirect you to https://bobcad.com/store or another store URL we configure. Checkout, payment, taxes, refunds, and fulfillment are handled on that store under its terms and privacy notice. We do not collect payment card numbers on this Site.

Training, support portals, forums, and the main website at bobcad.com have their own terms when you use them.

4. Contact form and communications

If you submit the contact form, you agree that the information is accurate to the best of your knowledge and that we may use it to respond, schedule a demo, and—if you check the email box—send product and demo email, as described in the Privacy Policy. You agree not to submit information about others unless you have the right to do so.

The form is not for emergencies, warranty claims that require a support ticket, or notices that must be given in a particular legal form. Do not submit sensitive personal information (such as Social Security numbers, payment card numbers, or health data).

We may refuse or ignore submissions that appear automated, unlawful, or abusive. A honeypot field and (in production) Cloudflare Turnstile are used to limit spam.

If you call 866-535-3744, ordinary call charges from your carrier may apply. We may record or log calls where the law allows and where we notify you if required.

5. Acceptable use

You will not, and will not attempt to:

  • Use the Site for any unlawful purpose or in violation of these Terms
  • Probe, scan, or attack the Site, or circumvent security, rate limits, or spam controls
  • Use bots, scrapers, or harvesting tools except as allowed by a written robots.txt rule or our prior written consent
  • Interfere with other users or with our service providers (including Zoho, Cloudflare, Azure, or Google Fonts)
  • Upload or transmit malware, or overload the Site with unreasonable traffic
  • Misrepresent your identity or affiliation, or submit false or misleading inquiries
  • Post or send content that is defamatory, infringing, or confidential to a third party
  • Use the Site to send spam or to enroll anyone else in marketing without their consent
  • Reverse engineer the Site except to the extent applicable law prohibits this restriction
  • Frame or mirror the Site without our written consent

We may block access, discard submissions, or take other action we reasonably consider necessary to protect the Site, our users, or our rights.

6. Intellectual property

The Site, including text, graphics, logos, icons, images, video, software, and layout, is owned by BobCAD or its licensors and is protected by United States and international intellectual property laws. BobCAD, BobCAD-CAM, and related marks are trademarks or registered trademarks of BobCAD-CAM, Inc. or affiliates. Other names are the property of their owners.

We grant you a limited, revocable, non-exclusive, non-transferable license to access and display the Site for your internal evaluation of our products, subject to these Terms. You may not copy, modify, distribute, sell, or create derivative works from Site content except as allowed by mandatory law or our written permission.

If you submit comments or suggestions, you grant us a worldwide, royalty-free, perpetual right to use them without restriction or compensation to you. You still own your message content; we do not claim ownership of your part files or manufacturing data, and you should not upload those to this marketing Site.

7. Third-party sites and services

The Site uses third-party services described in the Privacy Policy and Cookie Notice (including hosting, fonts, form processing, spam prevention, and optional chat). The Site may also link to third-party websites. We are not responsible for third-party content, terms, or privacy practices. Your use of those services is at your own risk and may be subject to additional terms.

8. Disclaimers

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL MEET YOUR REQUIREMENTS, BE ACCURATE OR CURRENT, OR BE FREE OF ERRORS, VIRUSES, OR SECURITY VULNERABILITIES.

Product information on the Site does not modify any EULA, warranty, or support terms that apply to software you license. CNC machining, programming, and manufacturing involve risk. You are solely responsible for verifying toolpaths, machine settings, and safety procedures. Nothing on the Site is professional engineering, legal, or safety advice.

Some jurisdictions do not allow certain disclaimers. In those places, our disclaimers apply to the fullest extent permitted.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BobCAD-CAM, Inc. AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO THE SITE OR THESE TERMS, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). THE EXISTENCE OF MULTIPLE CLAIMS WILL NOT ENLARGE THIS LIMIT.

These limitations are a fundamental part of the basis of the bargain and apply even if a remedy fails of its essential purpose. They do not limit liability that cannot be limited under applicable law (including, where such a waiver is forbidden, liability for fraud or for death or personal injury caused by our negligence).

10. Indemnity

You will defend, indemnify, and hold harmless BobCAD and its officers, directors, employees, and agents from and against claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your submissions, or your violation of these Terms or applicable law.

11. Governing law and disputes

These Terms are governed by the laws of the State of Florida, excluding its conflict-of-laws rules, and by applicable United States federal law. Except where prohibited, you and BobCAD agree that the state and federal courts located in Hillsborough County, Florida, have exclusive jurisdiction over disputes arising out of the Site or these Terms, and you consent to personal jurisdiction and venue there.

If you are a consumer resident in a jurisdiction that prohibits this venue or choice-of-law clause, the mandatory laws of that jurisdiction apply to the extent required.

You and BobCAD agree that each may bring claims against the other only in an individual capacity and not as a plaintiff or class member in any purported class or representative proceeding, to the extent such a waiver is permitted by law.

12. General

Entire agreement. These Terms, plus the Privacy Policy and Cookie Notice, are the entire agreement between you and us regarding the Site and supersede prior discussions about the Site. They do not supersede any EULA, purchase agreement, or other contract you have with us for software or services.

Changes. We may update these Terms by posting a revised version on this page and changing the “Last updated” date. Material changes will be indicated on the Site for a reasonable period. Continued use after the effective date constitutes acceptance. If you do not agree, stop using the Site.

Severability. If a provision is held unenforceable, it will be modified to the minimum extent necessary, and the remaining provisions will remain in effect.

Waiver. Failure to enforce a provision is not a waiver. Any waiver must be in writing to be effective.

Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets, or by operation of law.

Force majeure. We are not liable for delay or failure caused by events beyond our reasonable control, including network failures, labor disputes, natural disasters, war, or failures of our vendors.

Export and government use. You will not use the Site in violation of U.S. export or sanctions laws. Software you later license may have additional export restrictions in its EULA.

No third-party beneficiaries. These Terms do not create rights in any third party except as stated in the limitation of liability and indemnity sections for our personnel and suppliers.

Notices. We may provide notices by posting on the Site. You may provide legal notices to us at the address below. Informal inquiries can use the contact form or phone number on the Site.
